CYCLING WITH PURPOSE

By Michael Seton

The staff at Peninsula Law pride themselves on their commitment to engaging in a healthy work-life balance and their commitment to supporting important causes in the community.

On Sunday 7 November 2010, they had the opportunity to combine the two (again).

Following their successful completion of the 2009 MS Sydney To The Gong event, the firm entered a larger team in the 2010 MS Sydney To The Gong. The cycling event is run each year to raise awareness and funds for people affected by Multiple Sclerosis, with the money raised going towards providing a wide range of equipment, support and services to those people affected by the debilitating disease. This year, the event has raised, to date, over $3.2 million and organisers are confident that the target of $4 million is certainly possible as late contributions and cash donations are counted in the coming weeks.

Each member of the team from Peninsula Law managed to complete the 90km course from St Peters to Wollongong (some crossing the finish line in worse shape than others) and collectively raised $6,205 through donations from family, friends and clients.
While the entire team enjoys cycling socially and for fitness, they were thrilled to be involved in an event that supports such a wonderful cause.

Case Watch

On 12 November 2010, the High Court is to determine an application for leave to appeal filed on behalf of the Commonwealth DPP arising from a decision in the Supreme Court of South Australia. The decision of Poniatowska v DPP (Cth) [2010] SASCFC 19 held that section 135.2 does not define any duty or obligation relevant to an offence committed by way of an omission.

Should the decision of Poniatowska stand, this will have a significant effect upon all future prosecutions conducted by the Commonwealth.
