What is a normal claims process?

A claims process can vary in accordance with the specific nature of a claim, but in general it is in line with the following process:

  • Meet with the appointed Peninsula Law solicitor
  • Your solicitor will issue a notice of claim to the other party
  • Agreement is sought and negotiate on your behalf with the other party or their insurer
  • If no agreement can be reached, your solicitor will commence court proceedings
  • Your solicitor may seek to resolve the case out of court or will represent you in court to receive a judgment determined by the judge.
Will I need to go to court?

Most cases are settled before the commencement of court proceedings. In the event that agreement cannot be reached out of court and a judge is required to make a determination on the claim, your solicitor will represent you in court and advise you on the proceedings.

What happens if my claim is accepted?

After a claim is accepted, it makes into the assessment phase where damages are either agreed between the parties or determined by the Court.
